1. Acceptance of Terms

By accessing or using the Trapalanda mobile application (the "App"), our website at trapalanda.io (the "Website"), or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Services.

These Terms form a legal agreement between you and Trapalanda LLC, a Wyoming limited liability company ("Trapalanda," "we," "us," or "our") with registered address at 30 North Gould Street, Ste N, Sheridan, WY 82801, USA.

Our Privacy Policy is incorporated by reference into these Terms. By accepting these Terms, you also acknowledge the practices described in the Privacy Policy.

2. Description of the Service

Trapalanda is a travel planning application that helps users create and manage trip itineraries, including flights, accommodations, activities, packing lists, and related travel content. The App provides automated recommendations, alerts, and adjustments based on your itinerary data using artificial intelligence and third-party data sources (such as weather forecasts, flight status data, and destination news).

Trapalanda is not a travel agency, airline, accommodation provider, or eSIM reseller. We do not sell flights, hotels, tours, or other travel products. We provide informational and organizational tools to assist you in your own travel planning. You are solely responsible for booking, paying for, and confirming the travel arrangements you make outside of the Services.

3. Eligibility

You must be at least 13 years old to use the Services. If you are between 13 and the age of majority in your jurisdiction, you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

If you reside in the European Economic Area or the United Kingdom, the minimum age is 16 (or the lower age permitted by your country, no younger than 13), unless verifiable parental consent has been obtained.

You may not use the Services if you are barred from doing so under any applicable law.

4. Account Registration and Security

To access most features, you must create an account. You may sign in using Google Sign-In or Sign in with Apple. By doing so, you authorize us to access basic profile information from those providers as described in our Privacy Policy.

You agree to:

  • Provide accurate, current, and complete information.

  • Keep your credentials confidential.

  • Notify us promptly at support@trapalanda.io of any unauthorized use of your account.

  • Be responsible for all activity that occurs under your account.

You may delete your account at any time from within the App. Account deletion is subject to the retention practices described in our Privacy Policy.

5. User Content

The Services allow you to create, upload, and store content, including itineraries, notes, packing lists, photos, and other materials ("User Content"). You retain ownership of your User Content.

You grant Trapalanda a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, modify (for technical purposes such as formatting), and process your User Content solely to provide, maintain, and improve the Services, including by processing it through automated systems and third-party AI services as described in the Privacy Policy.

You represent and warrant that you have all rights necessary to grant this license and that your User Content does not infringe any third-party right or violate any law.

You are solely responsible for your User Content. We are not obligated to monitor User Content, but we reserve the right to remove or restrict User Content that we reasonably believe violates these Terms or applicable law.

6. Subscriptions, Payments, and Refunds

Trapalanda offers free and paid subscription plans. Paid subscriptions are processed exclusively through the Apple App Store or Google Play Store, and your billing relationship is with those stores, not directly with Trapalanda.

By purchasing a subscription, you agree that:

  • Your subscription will automatically renew at the end of each billing period until you cancel it.

  • The store will charge your designated payment method at the start of each renewal period at the then-current price.

  • You can cancel your subscription at any time through your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current billing period.

  • Refunds are handled exclusively by Apple or Google in accordance with their policies. We do not process refunds directly.

  • Trapalanda may modify subscription pricing, features, or plans on prospective notice; changes will not affect the current billing period.

Free trials, if offered, automatically convert to paid subscriptions unless cancelled before the trial ends.

7. AI-Generated Content and Travel Information

The Services use artificial intelligence to generate recommendations, alerts, packing lists, and itinerary adjustments. These outputs are informational suggestions only, generated by automated processes that may produce inaccurate, incomplete, or outdated results.

Travel-related data displayed in the Services (including flight status, weather forecasts, destination news, places, and prices) is provided by third-party data sources and is not guaranteed to be accurate, complete, or current.

You are solely responsible for verifying all travel-related information before relying on it for any decision, including booking, traveling, packing, or safety. Do not rely on the Services as the sole source of information for time-sensitive or safety-critical decisions.

8. Acceptable Use

You agree not to:

  • Use the Services for any unlawful, harmful, fraudulent, or abusive purpose.

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except where permitted by law.

  • Interfere with or disrupt the Services, servers, or networks connected to the Services.

  • Access the Services through automated means (scraping, bots, crawlers) without our prior written consent.

  • Bypass any technical or security measures.

  • Resell, sublicense, or commercially exploit the Services without authorization.

  • Upload User Content that is illegal, infringing, defamatory, obscene, harassing, or contains malware.

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

  • Collect or harvest information about other users.

We may suspend or terminate your access if we reasonably believe you have violated these Terms.

9. Intellectual Property

The Services, including all software, designs, text, graphics, logos, and trademarks (excluding User Content), are owned by Trapalanda or its licensors and are protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose, subject to these Terms. All rights not expressly granted are reserved.

10. Third-Party Services and Content

The Services integrate with and depend on third-party services (including, without limitation, Firebase, Apple, Google, RevenueCat, FlightAware, Flightradar24, Tomorrow.io, NewsAPI, Brevo, and Mapbox). Use of those services may be subject to their own terms and privacy policies. We are not responsible for the practices or content of third parties.

Links to third-party websites or services in the App are provided for convenience only. We do not endorse or assume responsibility for those sites.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

Without limiting the foregoing, we do not warrant that: (a) the Services will be available, secure, or error-free; (b) any information (including flight, weather, or destination data) will be accurate or current; (c) AI-generated recommendations will be suitable for your circumstances; or (d) any defects will be corrected.

Your use of the Services is at your sole risk.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

To the fullest extent permitted by law, Trapalanda and its officers, directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Services, even if advised of the possibility of such damages.

In no event will our total cumulative liability exceed the greater of (a) the amount you paid to Trapalanda through the App Store or Google Play in the twelve (12) months preceding the claim or (b) USD $100.

This section applies regardless of the legal theory on which the claim is based (contract, tort, statute, or otherwise). Some jurisdictions do not allow the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Trapalanda and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services;

  • Your User Content;

  • Your violation of these Terms; or

  • Your violation of any law or third-party right.

14. Termination

You may stop using the Services at any time and delete your account from within the App.

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or for any legitimate business reason.

Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.

15. Changes to the Terms or Service

We may update these Terms from time to time. If we make material changes, we will notify you through the App, by email, or by other reasonable means before they take effect. Your continued use of the Services after an update constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.

We may also modify, suspend, or discontinue any aspect of the Services at any time.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you and Trapalanda consent to the personal jurisdiction of those courts. The parties waive any objection based on inconvenient forum.

Nothing in this section limits your right to bring claims in small claims court where permitted, or, if you reside in the European Economic Area, the United Kingdom, Switzerland, or another jurisdiction granting such rights, your right under mandatory local consumer protection laws to bring claims in your local courts.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

17. Apple App Store and Google Play Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Trapalanda only, not with Apple. Apple is not responsible for the App or its content.

  • Your license to use the App is limited to use on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms.

  • Apple has no obligation to provide maintenance or support for the App.

  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

  • Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability, legal compliance, or consumer protection claims.

  • Apple is a third-party beneficiary of these Terms and may enforce them against you.

If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service.

18. Miscellaneous

  • Entire agreement. These Terms (together with the Privacy Policy and any additional terms you agree to) constitute the entire agreement between you and Trapalanda regarding the Services.

  • Severability. If any provision is held unenforceable, the remaining provisions will remain in full effect.

  • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.

  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.

  • Notices. We may provide notices to you through the App, by email, or by posting on the Website. You may send notices to us at support@trapalanda.io.

  • Force majeure. We are not liable for delays or failures resulting from causes beyond our reasonable control.
