1. Introduction

Welcome to Trapalanda, a service provided by SOUTHERN LIGHTS S.A.S. ('we', 'us', or the 'Company'). By accessing or using our mobile application and services (collectively, the 'Services'), you agree to be bound by these Terms and Conditions ('Terms'). If you do not agree to these Terms, please do not use our Services.

2. Definitions

We use the information we collect to:

• 'Trapalanda' or the 'App' refers to the travel itinerary planning platform and related services.

• 'User' or 'you' refers to any person who accesses or uses the Services.

• 'Content' refers to all information, text, graphics, photos, videos, or other materials uploaded, created, or appearing on the Services.

• 'Company' refers to SOUTHERN LIGHTS S.A.S., with CUIT 30718568990, located at Calle Brasil 56, Nueva Córdoba, Córdoba, Argentina.

3. Use of the Services

3.1 Elegibility: You must be at least 18 years old to use our Services. By using the App, you represent and warrant that you meet this requirement.

3.2 Account Registration: To access most features, you must register for an account. You can do so using your Google or Apple account, or via email and password. You agree to provide accurate and complete information during registration and to keep it updated.

3.3 Account Security: We use Firebase authentication services. You are solely responsible for safeguarding your account and for all activity that occurs under it. Notify us immediately of any unauthorized use.

3.4 User Conduct: You agree not to use the Services to:

• Engage in any illegal or fraudulent activity.

• Violate the rights of others, including intellectual property.

• Upload or transmit viruses, malware, or other malicious code.

• Attempt to gain unauthorized access to our systems or networks.

• Impersonate any person or entity.

4. Description of the Services

4.1 Travel Planning: The App allows you to create and manage travel itineraries. Information regarding flights, accommodations, and activities may come from third parties, and we do not guarantee its accuracy or availability.

4.2 Use of Artificial Intelligence: AI features are provided 'as is'. Information generated (such as recommendations or activity details) is for reference purposes and should be independently verified by the user before making any decisions.

4.3 Push Notifications: By using the App, you consent to receive push notifications. You can manage your notification preferences in your device or App settings.

5. Plans and Subscriptions

5.1 Plans: We offer a free plan and Premium subscriptions. The features and limitations of each plan are specified within the App.

5.2 Billing: Premium subscriptions are billed on a recurring basis (e.g., monthly or annually). Payment will be charged through the payment method associated with your App Store or Google Play account.

5.3 Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the renewal date.

5.4 Cancellation: You may cancel your subscription at any time through your account settings in the respective app store. The cancellation will take effect at the end of the current billing period.

6. User Content

6.1 Ownership: You retain all rights to the content you upload. However, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, and process such content for the sole purpose of operating, improving, and protecting the Services.

6.2 Prohibited Content: You may not upload content that is:\n- Unlawful, obscene, defamatory, threatening, or harassing.

• Infringes on the copyright, trademark, or privacy rights of others.

• Private or personally identifiable information of another person without their explicit consent.

7. Intellectual Property

All rights, titles, and interests in and to the Services (excluding User Content), including the software, design, text, graphics, and trademarks (such as 'Trapalanda'), are and will remain the exclusive property of SOUTHERN LIGHTS S.A.S. and its licensors. You are not permitted to use our branding or intellectual property without our prior written permission.

8. Privacy Policy

Our Privacy Policy, which is considered part of these Terms, describes how we collect, use, and share your personal information. By using our Services, you agree to the collection and use of information in accordance with that policy.

9. Termination

9.1 Termination by You: You may stop using our Services and delete your account at any time.

9.2 Termination by Us: We reserve the right to suspend or terminate your account and access to the Services, with or without notice, if we determine that you have:

• Breached these Terms.

• Created a risk or possible legal exposure for us.

• Engaged in fraudulent or illegal conduct.

10. Limitation of Liability and Warranties

10.1 No Warranties: The Services are provided 'as is' and 'as available,' without any warranties of any kind. We do not warrant that the Services will be uninterrupted, secure, error-free, or that the information obtained will be accurate or reliable.

10.2 Third-Party Links: The App may contain links to third-party websites or services (e.g., airlines, hotels, booking platforms). We are not responsible for the content, products, or services of such third parties.

10.3 Limitation of Liability: To the maximum extent permitted by law, SOUTHERN LIGHTS S.A.S. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, resulting from the use of the App.

11. Changes to the Terms

We reserve the right to modify these Terms at any time. If a change is material, we will provide you with reasonable notice (e.g., through the App or by email). Your continued use of the Services after the changes become effective will constitute your acceptance of the new Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Republic of Argentina. You agree to submit to the exclusive jurisdiction of the ordinary courts of the city of Córdoba, Argentina, for the resolution of any disputes.
